D/L74 02.09.2026 Bpg. C.R.M. (NDPS)1869 of 2026 In Re: An application for Bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Raninagar Police Station Case No.443 of 2025 dated 05.07.2025 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985; Asanul Islam Versus The State of West Bengal Mr. Debasis Kar Mr. Husen Mustafi Ms. Paramita Mukherjee Ms. Rimi Sil. …for the petitioner. Mr. Brajesh Jha Mr. Neel Chakraborty. …for the State. Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case. Two of the independent witnesses have turned hostile. Learned advocate for the State submits that the total subject matter of the case relates to alleged recovery of 223 bottles of Broncof-C Cough Syrup although the recovery from the present petitioner is 100 bottles of Broncof-C Cough Syrup. Having considered that the recovery was from the possession of the petitioner, I am of the opinion that Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the 2 petitioner in CRM(NDPS)1869 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
