ORAL ORDER The present writ petition is filed seeking the following prayers: A. Direct the LXXXV Addl. City civil and Sessions Judge and Commercial Court, Bengaluru (CCH-86) to dispose of com. O.S. No. 1599/2018, together with all pending interlocutory applications including l.A. Nos. 13, 14 and 15 of 2026 filed by Respondent No.2 vide Annexure-A on 23.07.2026 within an outer limit of three months from the date of receipt of a copy of the order of this Honble Court, by hearing the applications and the final arguments on a day-to-day basis in terms of

Order XV-A of the Code of Civil Procedure, 1908 as inserted by the Commercial Courts Act, 2015. B. Direct that no adjournment shall be granted in Com. O.s. No.1599/2018 except for reasons recorded in writing and on payment of actual costs in terms of section 35 of the Code of Civil Procedure, 1908 as substituted by the Commercial Courts Act, 2015 read with Order XVII thereof. C. Award the costs of these proceedings; and D. Grant such other or further reliefs as this Hon’ble Court may deem fit in the facts and circumstances of the case, in the interests of justice and equity.
2. This Court has called for a report from the concerned Judge, and the report is placed before this court, stating that the trial in the case was completed on 13.07.2026. The case was listed for final arguments on behalf of both sides on 19.08.2026. On that day, learned counsel for the plaintiff sought an adjournment of one week on the ground that the learned Senior Counsel was suffering from malaria fever. For the said reason, the case was adjourned finally for arguments on behalf of both sides by 28.08.2026. Presently, the case is

listed on 28.08.2026 for final arguments on behalf of both sides in the main suit.
3. Considering the report of the learned Judge, this Court is passing the following:
ORDER i. Accordingly, the writ petition is
disposed of, directing the Trial Court to dispose of the matter within a period of two months from the date of receipt of a copy of this order. ii. Pending IAs, if any, shall stand closed.
