JUSTICE JAYANT BANERJI) Heard the learned counsel for the complainant. 2. The learned counsel for the complainant states that as per the order of the writ court, the respondents were directed to consider the representations marked as Annexures K, M and P within two months, which was not done. Notice was issued to the accused. - 3 - HC-KAR CNR: KAHC010012832026 NC: 2026:KHC:47140-DB CCC No. 18 of 2026 3. The learned counsel appearing for the accused has referred to paragraph No.4 of the order, contempt of which is alleged, to contend that the court categorically recorded that the issue in the representations related to non-payment of interest on account of alleged delayed payment of salary. Accordingly, the representations were directed to be decided. 4. A compliance affidavit has been filed today, by Sri.K.H.Ramesh Babu, Depot Manager of BMTC. In paragraph No.6 of which it is stated as follows: “6. The claim of the complainant was examined and he was paid a sum of Rs.8,11,130 vide cheque dated 23.7.2021. The order passed in W.P.No.2246/2021 is dated 2.3.2021 and the amount was required to be paid on or before 2.6.2021 and the same was paid on 23.7.2021. Hence there was a delay of 1 month and four days, for this period the corporation was required to pay interest at 8% pa on Rs.8,11,140 from 2.6.2021 to 23.7.2021 This amount was quantified at Rs.7640, a cheque dated 20.3.2026 was prepared in the name of the complainant for a sum of Rs.7640 and was sought to be given to the complainant when he visited the central office. The complainant however declined to receive the - 4 - HC-KAR CNR: KAHC010012832026 NC: 2026:KHC:47140-DB CCC No. 18 of 2026 same, copy of the cheque drawn in the name of the complainant dated 20.3.2026 is produced and marked as Annexure R1.” 5. Further, paragraph Nos.7 and 8 of the compliance affidavit reads as follows: “7. It is respectfully submitted that in compliance with the order dated 15.1.2025, the representations submitted by the complainant was examined sum of Rs.7640 was sought to be paid towards Interest. This amount represented the interest claimed by the complainant for the delay period in paying the arrears i.e., for 1 month and 4 days. 8. The complainant has been issued with an endorsement dated 27.8.2026 in compliance with the order dated 15.1.2025 in W.P No 18679/2022 and the same was sent by RPAD to the complainant. True copies of the endorsement dated 27.8.2026 and copy of postal acknowledgement are produced and marked as Annexure R2 and R3.” 6. It is further stated that the Security Officer of the Corporation sought to serve the endorsement on the complainant in person on 27.08.2026 at his residence. Today, the learned counsel for the accused has referred to the Annexure R2, to contend that the amount of cheque that was prepared pursuant to the direction of the court, is available with her which she is prepared to hand over to the learned counsel for the complainant. The learned counsel for the complainant, however, states that he has no instructions to receive the same. 8. Since, we are of the considered opinion that the order of the writ court has been complied with, the contempt petition is consigned.
