JUSTICE SANJAY KUMAR MEDHI ORDER 06.03.2026 Heard Shri P. K. Roychoudhury, learned counsel for the petitioner. Also heard Shri H. Sarmah, learned Addl. Senior Govt. Advocate as well as Ms. G. Hazarika, learned Standing Counsel, Revenue Department. 2. Considering the subject matter involved and the instructions received by the learned State Counsel, this writ petition is taken up for disposal at the motion stage. Suffice it to mention that the matter had come up for consideration on two earlier occasions, when the learned State Counsel was granted time to obtain the instructions which he has accordingly done. 3. The grievance of the petitioner is within a short compass. The same relates to non-issuance of a certified copy. For ready reference, the relief prayed for in this petition is extracted herein below: “In the premises aforesaid it is prayed that this Hon'ble Court may graciously be pleased to admit this appeal, call for the records and issue notice upon the respondents to show cause as to why; i) a Writ of Mandamus should not be issued directing the Respondents to provide certified copies of the Jamabandi/orders dated 4-12-2021, 25-4- 2025, 17-9-2025 and 6-10-2025 of Dag No. 903, 932, 933 and 936 of Patta No. 773 of Mouza- Beltola, Lot No. 2, Village-Saukuchi under Dispur Revenue Guwahati (M) to the petitioner; Circle, ii) a Writ of Mandamus should not be issued directing the Respondents particularly the Respondent No. 2 and 3 to dispose of the application dated 31-10-2025 and 7-11-2025 (Annexure- B & C) filed by the petitioner; iii) any such other or further order should not be issued as may be deemed fit and proper. -AND- Upon perusal of the records and hearing the parties the Rule may be Page No.# 3/3 made absolute. And for this act of kindness the petitioner as in duty bound shall ever pray.” 4. Shri Roychoudhury, the learned counsel for the petitioner has submitted that certified copies of the concerned Jamabandi and orders was duly applied for and there is no reason not to supply the same. 5. On the other hand, Shri Sarmah, learned Addl. Senior Govt. Advocate has submitted that as per instructions received, there are two reasons for non supply of the certified copy. Firstly, the same was not submitted before the appropriate authority, namely, Circle Officer and secondly, the same was applied for in a physical form whereas such application is required to be made online. In this regard, he has placed before this Court written instructions dated 27.02.2026. 6. After going through the written instructions and after hearing the learned counsel for the contesting parties, this Court is of the opinion that the matter can be resolved by directing the petitioner to apply for certified copy before the appropriate authority, namely, the Circle Officer, Dispur Revenue Circle in the manner prescribed i.e. online. 7. It is however observed that if the application as indicated above, is made before the appropriate authority, the certified copies be made available to the petitioner within the prescribed period. 8.
