ORAL ORDER
After addressing the arguments for some time, memo came to be filed, which reads as under:
“The petitioner in the above case submits that petitioner has deposited a sum of Rs.35,000/- and another sum of

Rs.56,000/- before the 16th Addl.Chief Metropolitan Magistrate, Bengaluru and the same is in deposit before the Trial Magistrate. The petitioner undertakes to deposit the balance of the fine amount in a sum of Rs.49,000/- within a period of 2 months from today in compliance of the judgment and sentence impugned in the above petition. The amount in deposit and the further amount of Rs.49,000/- to legal representative of the complainant. WHEREFORE under the circumstances, the petitioner above named prays that this Hon’ble court be pleased to close the above petition and set aside the judgment and sentence of suspension impugned, in the interest of justice and equity.”
2. Counsel for the respondents has endorsed ‘no objection’ on the memo.
3. Placing the memo on record, revision petition stands
disposed of.
4. It is made clear that if the undertaking given by the petitioner in the memo is not complied, petitioner shall undergo imprisonment as ordered by the learned Trial Magistrate confirmed by the learned Judge in the First Appellate Court.

5. Amount in deposit is ordered to be withdrawn by the complainant under due identification, if not already withdrawn.
6. After payment of entire compensation amount, sum of Rs.10,000/- imposed by the learned Trial Magistrate confirmed by the First Appellate Court towards the defraying expenses of the State stands set-aside.
