In this writ application, the petitioner has prayed for a direction to set aside the final form submitted by the police in Sukhdeonagar P. S. Case No. 196 of 2024 by which the police has deliberately and maliciously given a colour of civil dispute to a criminal case lodged under Sections 406/420/467 and 120-B of the Indian Penal Code. It has been submitted by the petitioner in person that his land was usurped by the accused persons. He had lodged an FIR in Sukhdeonagar police station being Sukhdeonagar P. S. Case No. 196 of 2024, but after investigation the police in collusion with the persons against whom FIR was instituted has submitted final form showing the dispute to be of civil in nature. It has been submitted that on account of the influence of the accused persons, despite a criminal act having been committed by them -2- which is apparent from the FIR, but only on account of the fact that the subject matter of the case was related to a land, a deliberate and different hue has been given to the allegation. It has been submitted that a fresh investigation be made and in fact the higher authorities were approached with a prayer for a speedy as well as a proper investigation into the allegations made by the petitioner. Mr. Vivek Krishna, the petitioner in person has therefore, submitted that the final form being biased and influenced by the accused persons deserves to be set aside and a fresh investigation be ordered by an independent agency. Mr. Yogesh Modi, learned AC to AAG IA appearing for the State has submitted that after submission of final form, notice was issued by the learned court below. It has also been submitted that the petitioner has a remedy to file a protest petition before the concerned court instead of approaching this court for setting aside the final form. The main prayer of the petitioner seems to be of setting aside the final form submitted by the police in connection with Sukhdeonagar P. S. Case no. 196 of 2024 and conducting a fresh investigation into the allegations made by him. As would appear from the counter affidavit, after the submission of final form, a notice has been issued to the petitioner though, it has been stated by the petitioner that he was not aware of any notice having been served upon him. The petitioner has a remedy to approach the learned court in which the final form has been submitted by filing protest petition, but instead the petitioner has straightway approached this court in the present criminal writ application by imploring this court to go through the final form which would indicate the biasness of the police. In view of the remedy available to the petitioner, I am not inclined to entertain this writ application and consequently the same stands dismissed.
