C.R.M. (A)2905 of 2026
In Re: An application for anticipatory bail under Section 438 of Criminal Procedure Code, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Pukhuria Police Station Case No.310 of 2024 dated 15.06.2024 under Sections 363, 365 and 34 of the Indian Penal Code and charge-sheet submitted under Sections 363, 365, 376D and 34 of the Indian Penal Code, 1860;
Petitioner Versus The State of West Bengal & Anr.
Ms. Mousumi Bhowal Mr. Ishan Bhattacharya. …for the petitioner.
Ms. Rajashree Venket Kundalia Mr. Arindam Banerjee. …for the State.
Mr. Avik Ghatak Mr. Abhinav Rakshit. …for the de facto complainant.
Learned advocate appearing for the petitioner prays for anticipatory bail on issues which were earlier canvassed in CRM(A)1100 of 2025. The only ground which has been submitted as change of circumstance is the charge-sheet having been filed before the jurisdictional court.
Submission of a charge-sheet fortifies the accusation and is not a change of circumstance.
Accordingly, the present application for anticipatory bail being CRM(A)2905 of 2026 is dismissed.
Memo of Evidence submitted by the State be kept with
2 the record.
