1. The petitioner has applied to join in the Indian Army and he has already been shortlisted and he had passed in the first round and the second phase of the physical examination is fixed on September 15, 2026. On September 15, 2026, the petitioner has to submit the domicile certificate but due to the deletion of the name of the petitioner from the voter list, the authorities are not providing domicile certificate to the petitioner.

Learned counsel for the petitioner prays for a direction upon the appellate authority for disposal of the appeal as early as possible so as to enable the petitioner to obtain domicile certificate from the concerned authority to appear in the examination which is scheduled to be held on September 15, 2026.
3. In view of the submission made by the learned counsel for the petitioner, the appellate tribunal is requested to dispose of the appeal filed by the petitioner as early as possible preferably within a period of one week from the date of the receipt of this order.

4. The physical examination of the petitioner is fixed on September 17, 2026 and without the domicile certificate, the petitioner will not be allowed to participate in the physical examination test by the defence authorities. Accordingly, the Sub-Divisional Officer, Basirhat is
directed to provide provisional domicile certificate to the petitioner if the petitioner is otherwise eligible other than the condition that the name of the petitioner is deleted from the voter list with an undertaking by the petitioner that if the petitioner failed to succeed in the appeal before the appellate tribunal, the petitioner shall surrender the domicile certificate to the concerned authority within a week from the date of order of the appeal.
5. The SDO, Basirhat is directed to provide the provisional domicile certificate to the petitioner subject to the above condition within a period of one week from the date of the receipt of this order.
6. WPA 24142 of 2026 is disposed of.
7. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
