Through the instant petition, filed under Section 482 of BNSS, 2023, the petitioner seeks anticipatory bail in case arising out of DDR No.43, dated 31.10.2025, registered under Sections 109, 118(1), 115(2), 191(3) and 190 of the BNS (offence under Section 109 of BNS was deleted lateron) in FIR No.186, dated 31.10.2025, registered under Sections 109, 115(2), 191(3), 190 and 324(4) of the BNS (offence under Section 109 of BNS was deleted later on), at Police Station Sadar Sri Muktsar Sahib, District Sri Muktsar Sahib. 2. Vide order dated 15.07.2026, passed by this Court, the petitioner was released on interim bail and was directed to join investigation. The operative part of the order dated 15.07.2026 reads as under:

“The aforementioned FIR No.186 was registered on 31.10.2025 on the basis of a statement recorded by complainant – Yadwinder Singh @ Yadu alleging that accused Harsimran Singh @ Simmi, Karanbir Singh, Lovepreet Singh @ Lavi, Somjit Singh @ Soma, Angrej Singh @ Geja and others had voluntarily caused injuries to them on the night of 29.10.2025. On the same day, the aforementioned DDR No.43 was also recorded on the basis of statement recorded by Harmandeep Singh, a member of the opposite party, alleging therein that on the evening of 29.10.2025, when he was going towards the grain market, the present petitioner, while driving a truck at a high speed had tried to run him over with an intent to kill him. The truck then rammed into the heap of paddy belonging to his cousin which scattered the paddy grains. Thereafter, the accomplices of the petitioner had opened an assault upon the complainant and had caused injuries to him as well as his cousin brothers, namely Malkit Singh and Harsimran Singh @ Simmi. Initially, a case under Sections 109, 118(1), 115(2), 191(3) and 190 of the BNS was registered but subsequently, offence under Section 109 of the BNS was deleted. Apprehending his arrest, the petitioner moved an application for grant of anticipatory bail before the Additional Sessions Judge, Sri Muktsar Sahib, which had been dismissed vide order dated
03.0.6.2026.

It is case of version and cross-version. The aforementioned FIR had already been registered on the basis of statement recorded by a member of his group. This DDR is a counter blast to the same. No specific act has been attributed to him. He is ready to join the investigation. His custodial interrogation is not required. The subject offences are triable by the Magistrate. With these broad submissions, it is urged that he deserves to be extended the benefit of pre-arrest bail. Notice of motion. On the asking of the Court, Ms. Ruchika Sabherwal, learned Sr. DAG, Punjab accepts notice and seeks time to file status report. Adjourned to 19.08.2026
In the meantime, the petitioner is directed to appear before the Investigating/Arresting Officer to join investigation within one week or as and when required. In the event of his arrest, the Investigating/Arresting Officer shall release the petitioner on interim bail on furnishing personal/surety bonds to his/her satisfaction. The petitioner shall also abide by the conditions as envisaged under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. It would, however, be open to the learned State counsel to file a reply indicating the involvement of the petitioner and all aspects would be considered at the time of final adjudication of the matter.”
3. Status report has been filed by the respondent-State. Learned State counsel, on instructions from the Investigating Officer, has submitted that the petitioner has joined investigation on 15.07.2026 and he is not MOHAMMAD WASEEM ANSARI 2026.08.27 14:05 I attest to the accuracy and integrity of this document

required for custodial interrogation. It is also submitted that recovery of weapon of offence i.e. daang has been effected from the petitioner. 4.
Learned counsel for the complainant, however, has argued that victim Malkiat Singh had sustained several injuries in the incident at the hands of the petitioner and other co-accused, due to which, his testicles had been removed, which attracted invocation of offence under Section 109 of BNS, though the same was wrongly deleted later on. It is also argued that by invoking the provisions of Section 109 of BNS, the petitioner is vicariously liable for the act of co-accused as well and hence does not deserve to be given concession of bail.

Admittedly, the offence under Section 109 of BNS, which was initially invoked, has subsequently been deleted. Moreover, as per the status report, the only injury attributed to the petitioner on the person of injured Malkiat Singh is an injury on his right knee, which has been opined to be simple in nature. The petitioner has already joined the investigation on 15.07.2026 and learned State counsel, on instructions from the Investigating Officer, has fairly submitted that his custodial interrogation is not required. In view of the aforesaid facts and circumstances, but without meaning to make any comment on the merits of the case, the petition is allowed and the interim bail granted to the petitioner vide order dated 15.07.2026 is made absolute, subject to the conditions already imposed therein.
