JUSTICE ASHOK S.KINAGI ORAL ORDER Petitioner has filed this writ petition seeking for following reliefs: "i) Issue an order or direction particularly in the nature of certiorari quashing the show cause notice of the 3rd respondent dated 08.10.2024 shown at Annexure-K and subsequent actions taken upon it bearing No. ಸಂ ಸಂ ಸಂ ಸಂೆೆೆೆ: 8(8888) ಾಾಾಾ ಅಅಅಅ . ಾಾಾಾ . ರದು ರದು ರದು ರದು E-1524477:63/2024-25. ii) Issue an order or direction particularly in the nature of Mandamus directing the respondents to consider the representations/replies dated 08.11.2024 Annexure-L, Annexure -M dated 08.11.2024, Annexure - N dated 08.11.2024 and annexure - P dated 14.11.2024 addressed to the respondent 5, 4 and 3. (iii) Issue an order or direction particularly in the nature of mandamus directing the respondents to permit the petitioner to continue the school and also permit them to pay 10th exam fees of the students as per the Annexure-L, Annexure-M, Annexure-N and Annexure-P addressed to the respondent 5, 4 and 3 respectively; (iv) Issue such other orders or directions as this Hon'ble Court deems fit, just and proper under the facts and circumstances of the case and allow this petition in the interest of justice and equity." - 4 - HC-KAR CNR: KAHC010728622024 NC: 2026:KHC:46311 WP No. 34482 of 2024 2. The petitioner is running a private aided High School in the name and style of Gnanabharathi High School at Vaderahalli, Madhugiri Taluk, and the School was running successfully imparting to the education, to the social and economical backward classes of rural area in Madhugiri Educational District. The student strength for the academic year 2024-25 fall short of six students. As a result, 3rd respondent issued show cause notice under Section 39 of Karnataka Education Act, 1983 seeking explanation why recognition cannot be withdrawn. Along with the show cause notice the respondent No.3 has directed respondent Nos.4 and 5 to take action in shifting the aided staffs to some other schools and to issue transfer certificates to all the students and such direction was given without hearing the petitioner herein. 3. The petitioner has submitted representation on 08.11.2024 to respondent Nos.3 to 5 requesting to permit them to pay examination fees of 10th standard students and the petitioner also undertook that they will close the school in case the students strength is not improved in 2025-2026. - 5 - HC-KAR CNR: KAHC010728622024 NC: 2026:KHC:46311 WP No. 34482 of 2024 4. Respondent No.5 - BEO without any order directed the Head Master of the school to issue Transfer Certificate and gave the clear instructions to the students to join some other schools without passing any order under the Karnataka Education Act. 5. The petitioner aggrieved by the action of respondent No.5 in directing the Head Master to close the School and to issue Transfer Certificate filed this writ petition on 12.12.2024. 6. Learned HCGP for respondents submits that already Transfer Certificate was issued to the students who were students in the petitioner's school and already the teachers who were discharging their duties in the said school has been transferred to aided school and now the school has been closed. To substantiate the contention, she has produced the copy of the order passed on 09.12.2024. The learned HCGP has produced the records that the school has already been closed. - 6 - HC-KAR CNR: KAHC010728622024 NC: 2026:KHC:46311 WP No. 34482 of 2024 7. In view of the same, nothing survives for consideration in this writ petition. 8. Accordingly, the writ petition is dismissed.
