C.R.M. (NDPS)1891 of 2026
In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bongaon Police Station Case No.624 of 2013 dated 18.08.2013 under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Ramesh Pandey Versus The State of West Bengal
Mr. Soumik Ganguli Ms. Priti Burman. …for the petitioner.
Mr. Lokesh Sharma Mr. Shataroop Purkayastha. …for the State.
The background of the case reflects that the petitioner was evading the process of law for a considerable period of time. Case was registered in the year 2013. Petitioner was initially granted bail. After the bail was granted, because of evading the process of law, harsher process was issued and subsequently on execution of warrant of arrest petitioner was arrested and produced before the court in the year 2025.
Petitioner presently is in custody for 1 year 5 months. Earlier, when the petitioner approached before this Court there was a direction for the petitioner to renew his prayer for bail after the charges are over. Charges have already been framed.
Having regard to the fact that the case was registered in
2 the year 2013, I direct the learned trial court to give priority to the evidence of the seizure list witnesses. The same be completed preferably within a period of four months from the next date fixed. After the evidence of the seizure list witnesses are over, the learned trial court on an application for bail by the petitioner would leniently consider the same in accordance with law.
With the aforesaid observations, CRM(NDPS)1891 of 2026 is disposed of.
Memo of Evidence submitted by the State be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
