ORAL ORDER
1. Learned Additional Government Advocate accepts notice for respondent nos.1 to 3.
2. Petitioner is before this Court seeking for the following reliefs:

a. Issue a Writ in the nature of Mandamus, or any other appropriate Writ,
Order, or Direction, directing the Respondents to immediately delete, remove, and clear the entry of temporary injunction/non-alienation concerning the Schedule Property from the Kaveri online web portal (www.kaveri.karnataka.gov.in) (ANNEXURE P) b. Direct the Respondent No. 2 and 3 to seamlessly entertain, process, and register any sale deeds, conveyance deeds, or alienation documents presented by the Petitioner in respect of the Schedule Property or sites formed therein without raising any objection with respect to vacated Injunction order. c. Grant such other relief or reliefs as this Hon'ble Court deems fit and proper under the facts and circumstances of the case, in the interest of justice and equity.

An entry as regards the injunction order passed in M.A.No.40/2022 by the III Additional Senior Civil Judge, Bengaluru Rural District, having been entered in the encumbrance certificate, the petitioner claimed that an injunction order had been vacated and submitted a representation for deletion of the said entry. The said representation not having been considered, the petitioner is before this Court seeking for the aforesaid reliefs.
4. The encumbrance certificate maintained by the Sub- Registrar is required to indicate all the transactions which have taken place with respect to the said property. An injunction order, being one such aspect,

is required to be part of the register even if the injunction order were to be vacated. At most, what the petitioner can claim for is the registration of an
order of vacating the interim order and not for deletion of the earlier order of injunction.
5. In that view of the matter, the relief sought for are moulded. The petition is disposed.
6. Respondents are
directed to consider the representation of the petitioner, verify the orders passed and if indeed the order of injunction has been vacated, to cause entry in the register about the vacating of the interim order passed in M.A No.40/2022, in the register within a period of thirty (30) days from the date of receipt of a copy of this
order, while keeping the earlier entry intact.
