1. Learned Senior Counsel limits his arguments to the submission that the inquiry is being continued for a prolonged period since 2020 when the charge-sheet was issued to him and
[2026:RJ-JP:13309-DB] (2 of 2) [SAW-278/2026] till date, only an Inquiry Officer has been appointed. No further proceedings have taken place.
2. Learned Senior Counsel submits that the petitioner constituted a committee that he was authorized under the Rules in
order to perform his duties, for which a charge-sheet has been issued to him. He therefore submits that the petitioner has not committed any mistake. Learned counsel further submits that certain observations have been made by the learned Single Judge which would affect the inquiry proceedings.
3. Learned Additional Advocate General submits that he would have no objection if the Inquiry Officer is directed to conduct the inquiry without being prejudiced in any manner by the observations made by the learned Single Judge.
4. Taking note of the submissions, we dispose of this appeal with direction to the Disciplinary Authority to conclude the disciplinary proceedings within nine months.
5. It goes without saying that the Inquiry Officer shall deal with all the submissions raised by the petitioner in his defence and prepare a fair and speaking inquiry report. The Disciplinary Authority would also examine the inquiry report and the reply given by the petitioner to the inquiry report and pass a speaking
order without being influenced by any observations made by learned Single Bench in the impugned order.
6. The present Special Appeal (Writ) is accordingly disposed of.
7. All pending application(s) also stand disposed of.
