This application has been preferred by the appellant for condoning a delay of 5 days in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 5 days in filing the appeal is hereby condoned. I.A. No.3076 of 2026 stands disposed of. Cr. Appeal (DB) No. 317 of 2026
This appeal is directed against the order dated 20.01.2026 passed by the learned Sessions Judge, Garhwa in B.P. No.03 of 2026 arising out of Danda P.S. Case No. 35 of 2025 whereby and whereunder the prayer for bail of the appellant has been rejected. It has been alleged that the child of the informant was given to Satwanti Devi and the present appellant and subsequently the child was handed over to Urmila Devi and Rimi Devi on the assurance that they will take proper care of the child. The informant had later on come to know that the infant was sold by Satwanti Devi, Sima Devi and the present appellant for Rs.2.5 Lakh to Urmila Devi and Rimi Devi. Submission has been advanced by the learned counsel for the appellant that Sima Devi whose case is similarly situated to that of the appellant, has been granted bail by this Court in Cr. Appeal (DB) No.195 of

2026. It has further been submitted that the child has been recovered from the custody of Urmila Devi and Rimi Devi. Learned counsel adds that the appellant is in custody since 15.12.2025. Learned A.P.P though has opposed the prayer for bail of the appellant but has not disputed the fact that the case of the present appellant is similar to that of Sima Devi who has been granted bail, as noted above.
On consideration of the aforesaid facts, we while setting aside the order dated 20.01.2026 passed by the learned Sessions Judge, Garhwa in B.P. No.03 of 2026 arising out of Danda P.S. Case No. 35 of 2025, direct the appellant to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Garhwa in B.P. No.03 of 2026. This appeal stands allowed and disposed of. (Rongon Mukhopadhyay, J.)
