4. Instant FIR was registered on the basis of statement of complainant-Vikas Saharan alleging that he is running Sham Vaishno Dhaba on the main road at village Khetla. On 25.06.2025, Sandeep Singh @ Monu was sitting on the counter, whereas he was working when Karamjeet Singh @ Karma who often visited his Dhaba and whom he knew, came on Thar bearing No.PB-31Y-0666 and he gave the order for food and he served him with pulses. As he made demand of money, he started abusing him. He threw the plate and threatened to see him and left the spot. On 26.06.2025 at 3:30 am, two vehicles, one Fortuner bearing No.PB-11BT-9999 and Thar bearing No.PB-31Y-0666 stopped at his Dhaba, from which Karamjeet Singh @ Karma came out with sword, Davinder Singh @ Binder Singh with Gandasa, Amrik Ram with Takua, Babbu resident of Ramgarh with sword along with 04 unknown persons, who were also armed with swords and rods. They raised lalkaras and started beating him. Karamjeet Singh with intent to kill him gave a sword blow towards right side of head. Davinder Singh gave Gandasa blow towards him and as he raised his right hand, the blow hit his right hand. Babbu gave sword blow which fell on his left hand.
Amrik Singh gave Takua blows on his right and left legs. The unknown persons inflicted injuries on his right arm. They also damaged his goods lying in the Dhaba. On his alarm, Sandeep Singh @ came to his rescue and said persons fled. 5. As per allegations in the FIR, accused persons namely (1) Karamjeet Singh @ Karma armed with a sword, (2) Davinder Singh @ Binder armed with axe, (3) Amrik Ram armed with an axe, (4) Babbu along with four unknown persons holding swords and rods in their hands, alighted together from two vehicles bearing No.PB-11BT-9999 and PB-31Y-0666 and caused injuries to the complainant as under:- JAWALA RAM 2026.09.03 19:54 I attest to the accuracy and integrity of this document
CRM-M-39740-2026 3 (i) Petitioner-Karamjeet Singh @ Karma gave a blow on the right side head of complainant-Vikas Saharan. (ii) Accused-Davinder Singh @ Binder gave axe blow on the right hand of the complainant. (iii) Accused-Amrik Ram gave two sword blows on right leg and left leg of the complainant. (iv) Accused-Babbu gave sword blow on the left hand of the complainant. (v) Unidentified persons also caused injuries on the right arm with the weapons which they were holding. Despite falling down of the complainant on ground, several kicks blows were given to him and the articles lying the Dhaba were vandalized. 6. Counsel argues that MLR of injured reflects 09 injuries, out of which, injury nos.1, 3 & 5 were declared as grievous in nature and offence under Section 117(2) BNS was enhanced. Remaining injuries were declared to be simple in nature. Weapon used for injury no.1 was reported to sharp and said injury was attributed to petitioner-Karamjit Singh @ Karma and 3 weapon used for remaining injuries was found to be blunt edged weapon. Injury No.3 is caused on the left hand and injury no.5 on the right leg of injured. Injury on the right leg has been attributed to accused-Amrik Ram.
Counsel argues that role attributed to the petitioner is of giving sword blow on the head of the complainant, but the injury was declared as simple. The other main accused namely Amrik Ram and Babbu Singh, who caused grievous injuries on the left hand and left leg of complainant, both were granted bail by the trial Court, vide order dated 29.09.2025 (Annexure P-6) and order dated 02.02.2026 (Anenxure P-8) respectively. Further argues that injured/complainant is not coming forward for deposing in the witness box for the last four occasions. Thus, prays for JAWALA RAM 2026.09.03 19:54 I attest to the accuracy and integrity of this document
CRM-M-39740-2026 4 grant of bail to the petitioner. 7. Learned State counsel does not dispute the factual position explained and recorded hereabove, but submits that petitioner is involved in many other cases, which are detailed hereunder:- (1) FIR No.13 dated 19.01.2017 under Sections 295-A, 323, 427, 506 IPC, Police Station Dirbha. (2) FIR No.225 dated 30.10.2021 under Sections 307, 506, 109, 34, 120-B IPC, Sections 25/27/54/59 of Arms Act, Police Station Dirbha. (3) FIR No.140 dated 13.07.2020 under Sections 307, 34 IPC, Section 25 of Arms Act, Police Station Division No.7 (Vardhman). Thus, submits that petitioner is not entitled for seeking the concession of bail. 8.
