consideration and release of the admissible financial benefits payable to the Petitioners under the "अनुसूचित जातित एवं जानुजातित वंर्ग की छात्राओं की चिए नुर्सिंसूर्ग पाठ्यक्रम म तिनु शुल्की अध्ययनु की सूतिवंधा य&जानु वंर्ष 2008-09 यथा सूशु&धिधात (2012)", which has remained unpaid despite completion of the B.Sc. Learned counsel for the petitioners submits that the petitioners are Scheduled Tribe female students who were admitted to the four-year B.Sc. Nursing Course for the academic session 2018-19 at Mother Teresa Nursing College, Sonwahi, District Surajpur, Chhattisgarh. During the course of their studies, the Petitioners were selected for the benefits under the Scheme known as "अनुसूचित जातित एवं जानुजातित वंर्ग की छात्राओं की चिए नुर्सिंसूर्ग पाठ्यक्रम म तिनु शुल्की अध्ययनु की सूतिवंधा य&जानु वंर्ष 2008-09 यथा सूशु&धिधात (2012)" (hereinafter referred to as the "Scheme"), implemented by the State of Chhattisgarh for eligible Scheduled Caste and Scheduled Tribe female students. Under the Scheme, the Petitioners became eligible for the financial benefits and reimbursement of the non-refundable fees paid to the College, in accordance with the terms and conditions of the Scheme. The petitioners were informed by the College administration that their names had been shortlisted under the Scheme and were accordingly required to approach the office of the concerned department and submit the necessary details relating to their admission and the non-refundable fees paid to the College. Pursuant thereto, the Petitioners approached the office of the Respondent No. 4 (Assistant Commissioner, Surajpur), and submitted the requisite details and the non-refundable fees
3 paid to the College, for consideration of their claim under the Scheme. The Petitioners were also informed that the reimbursement under the Scheme was to be made in accordance with the applicable provisions of the Scheme, including the category of the student and the nature of accommodation, as applicable. The Petitioners thereafter continued their studies and successfully completed the four-year B.Sc. Nursing Course. However, the benefits payable under the Scheme were not released to them in full. On 01.02.2024, an amount of 58,730/- was credited to the respective bank accounts of the ₹
Petitioners towards the first installment under the Scheme. However, the remaining amount claimed by the Petitioners, including the amounts relating to the subsequent academic years, has not been released. 3.
Learned counsel for the State submits that office of the Commissioner, Tribal and Scheduled Caste Development, vide letter dated 21.08.2026 pointed out that the verification report earlier submitted by the office at Surajpur did not carry the name of the college and the students concerned, including the Petitioners’. The Assistant Commissioner, Surajpur was accordingly directed to re-examine the matter and send a new proposal with recommendation, so that further action could be taken. Thereafter, on 31.08.2026 another letter was addressed by Assistant Commissioner, Tribal Development, Dist.- Surajpur to Commissioner, Tribal and Scheduled Caste Development requesting to release the funds. 4. Having considered the submissions made by learned counsel for the parties and having regard to the fact that the claim of the petitioners is stated to be under consideration at the departmental level, this Court deems it appropriate to dispose of the present writ petition with a direction to the Assistant
4 Commissioner, Tribal Development Department, Surajpur, to examine and consider the grievance/claim of the petitioners under the aforesaid Scheme and, after verification of their entitlement and the relevant records, pass an appropriate reasoned and speaking order in accordance with law. 5.
