ORAL ORDER
1. Learned AGA accepts notice for respondent Nos.1 to
4.
2. Notice to respondent Nos.5 to 8 is dispensed with, in view of the proposed order to be passed.
3. The petitioners are before this Court seeking for the following reliefs: '' (a) issue a Writ of Mandamus, or any other appropriate writ, order or direction, directing Respondent No.4 to forthwith register a First Information Report on the basis of the Petitioners' complaint dated 17.03.2026 (Annexure-D) / the Private Complaint in P.C.R. No.188/2026 (Annexure-G), for the offences punishable under Sections 61(2), 318(2), 318(4), 316(2), 336(2), 336(3), 338 and 340(2) of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Sections 120B, 419, 420, 406, 465, 468, 467 and 471 of the Indian Penal Code, 1860), and to thereafter investigate the same in accordance with law; (b) in the alternative, and without prejudice to prayer (a) above, issue a Writ of Mandamus, or any other appropriate writ, or direction, directing the Court of the III Addl. Civil Judge & JMFC, Anekal, to consider and dispose of the Petitioners' Application dated 07.07.2026 filed under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, in P.C.R. No.188/2026 (FR No. PCR/200/2026) (Annexure-H), within a period of one (1) week from the date of receipt of a certified copy of the
order passed in this Writ Petition; (c) grant such other reliefs as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice and equity."

4. The grievance of the petitioners is that the official respondents have not registered an FIR in response to the complaint submitted by the petitioners on 17.03.2026, and it is in that background that the aforesaid reliefs has been sought for.

Learned counsel for the petitioners submit that respondent Nos.5 and 6 had approached the petitioners with the intention to purchase the petitioners' property. When photocopies of these documents had been furnished, subsequently the petitioner received summons in O.S.No.319/2026 filed by respondent No.5 for specific performance before the Senior Civil Judge and JMFC, Anekal, in respect of an alleged Agreement of Sale dated
18.01.2026.

Learned counsel for the petitioners submitted that the petitioners have not signed the said Agreement of Sale and that the signature found thereon are forged and in that background, the complaint was

submitted. Since a civil suit is already pending in OS No.319/2026, the petitioners can always agitate their defences therein and even get the document referred for examination to a Forensic Science Laboratory (for short ' FSL').
7. If a report is received from the FSL, then necessary action could be taken by the petitioners. At this stage, when O.S.No.319/2026 is pending, which indicates a civil dispute, the question of registering a criminal complaint would not arise.
8. Reserving liberty to the petitioners to file a complaint after obtaining necessary orders in the said suit in OS No.319/2026, the petition stands disposed of.
