Heard Sri Ch. Karthik, learned counsel representing Sri V. Nitesh, learned counsel for the petitioner. 3. Learned counsel for the petitioner submits that the petitioner filed O.S.No.23 of 2025 before the Court below against 1st respondent /defendant, for recovery of an amount of Rs.4,55,850/-, on the foot of two promissory notes, with interest @18% p.a. from the date of filing of the suit to till the date of realization. Pending the suit, on 09.01.2026, the petitioner filed I.A.No.75 of 2026 under Order XXXVIII Rule 5 of the Code of Civil Procedure, 1908 (C.P.C) seeking attachment an amount of Rs.4,55,850/-, out of Rs.8,45,000/- being the retirement benefits under the Head of earn leave salary and leave salary, of the respondent, which is lying with the petition schedule mentioned authorities viz. 2nd respondent herein. Later, the matter was listed for consideration on several occasions, however, the trial Court has not passed any orders thereon. He further submits that the respondent is going to retire by the end of June, 2026, and that if he retires, the entire benefits would be disbursed, in which event the petitioner would suffer irreparable loss and hardship. Hence, he prays a direction for expeditious disposal of the said I.A. 4 4. In view of the facts and circumstances of the case and in view of the urgency expressed by the learned counsel for the petitioner, without going into the merits of the matter, the Civil Revision Petition is disposed of, directing the learned Junior Civil Judge, Sidhout to consider and dispose of I.A.No.75 of 2026 in O.S.No.23 of 2025, in accordance with law, within a period of two (02) weeks from the date of receipt of a copy of the order.
