Learned advocate for the petitioners submits that there was a dispute over a boundary for which the petitioners have been foisted with the criminal case. Learned advocate for the State opposes the prayer for anticipatory bail. The attention of the court has been drawn to the injury report as well as the statement of the injured.
2 I have taken into account the fact that five stitches had to be administered upon the victim and there were three individuals present at the time of the alleged offence. I have also taken into account the fact that there were some specific overt acts attributed to Bikash Shil and so far as the present petitioners are concerned, they were present on the spot and their participation cannot be ruled out. However, having considered that the present petitioners are ladies, I am inclined to grant anticipatory bail to the present petitioners. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Piyali Shil and Anita Shil] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
2023. As the investigation is in progress, the petitioners shall make themselves physically available as and when they would be required by the I.O. of the case for the sake of investigation. Accordingly, CRM (A) 2893 of 2026 is disposed of.
3 Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
