NARENDRA PRASAD ORAL ORDER This writ petition is filed by the defendants under Article 227 of the Constitution of India, challenging the order dated 02.04.2026 passed by the LXXXII Additional City Civil and Sessions Judge, Bengaluru (for short, “the trial court”) on I.A. Nos. 9 and 10 in Com.O.S. No. 9055/2013, whereby the applications filed by the - 3 - HC-KAR NC: 2026:KHC:21955 WP No. 12589 of 2026 defendants under Section 151 of the Code of Civil Procedure (for short, “CPC”) have been dismissed with costs. 2. For the sake of convenience, the parties are referred to as per their ranking before the trial court. 3. The respondent/plaintiff filed a suit in Com.O.S. No.9055/2013 for recovery of money. Upon appearance, the defendants filed their written statement. The matter was initially before a regular court. In view of the establishment of Commercial Courts under the Commercial Courts Act, 2015the matter was transferred to the Commercial Court on 23.02.2023. Thereafter, the matter was posted for the defendants’ evidence. At the request of the defendants, it was adjourned to 18.10.2025 and 11.11.2025. On 11.11.2025, the defendants’ evidence was taken as nil. 4. Subsequently, the defendants filed applications seeking reopening of the stage of their evidence and - 4 - HC-KAR NC: 2026:KHC:21955 WP No. 12589 of 2026 permission to adduce evidence. The said applications came to be dismissed. Being aggrieved, the defendants have approached this Court. 5. No doubt, the Commercial Court has afforded sufficient opportunity to the defendants to adduce evidence. However, the defendants failed to do so. 6. The learned Senior Counsel appearing for the petitioners/defendants contended that the defendants were under the impression that the matter would be settled between the parties and, therefore, they did not adduce evidence. Since the matter was not settled, they are now seeking an opportunity to adduce evidence. Be that as it may. 7. In the interest of justice, one more opportunity deserves to be granted, subject to certain conditions. Accordingly, the following order is passed: (i) The writ petition is allowed. - 5 - HC-KAR NC: 2026:KHC:21955 WP No. 12589 of 2026 (ii) The order dated 02.04.2026 passed on I.A. Nos. 9 and 10 in Com.O.S.No.9055/2013 is set aside, and the said applications filed by the defendants under Section 151 of CPC are allowed. (iii) The defendants are permitted to reopen the stage of their evidence. (iv) The defendants shall examine their witnesses on the next date of hearing, i.e., on 27.04.2026, without seeking any further adjournment. (v) If the evidence is not concluded on 27.04.2026, the defendants shall conclude the same on the next date to be fixed by the trial court. (vi) The trial court is directed to dispose of the suit as expeditiously as possible, and in any event not later than the end of August 2026, provided - 6 - HC-KAR NC: 2026:KHC:21955 WP No. 12589 of 2026 there is no order of stay of the said proceedings granted by any court of law.
