CORAM:
Hon’ble Mr Justice Yash Paul Bourney, Judge.
(ORDER) 09.10.2026
CrlM No. 1904/2026:
01.
This is an application moved by the Applicants/ Petitioners seeking permission of this Court for placing on record the cognizance
Order, as directed by this Court vide Order dated 15th of September, 2026 read with Orders dated 22nd of September, 2026 and 6th of October, 2026.
02.
For the reasons stated in the application and those urged at the Bar, the present application is allowed and the cognizance Order is taken on record.
03.
CrlM No. 1904/2026 is, accordingly, disposed of.
CRM (M) No. 750/2026; CrlM No. 1693/2026; CrlM No. 1694/2026:
04.
Through the medium of this Petition, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [ for short “the BNSS”], the Petitioners have essentially assailed a pre-cognizance notice issued to them in terms of Section 223 of the BNSS.
05.
The grievance projected by the Petitioners, in this Petition, is that both the Petitioners are senior citizens in old age and are not in a position to travel along, so they may be exempted from appearing in person before the learned Trial Magistrate.
06.
Having heard the learned Counsel appearing for the Petitioners and considering the fact that challenge is thrown only to a pre-cognizance notice, to which the Petitioners are yet to respond, therefore, it would be in the fitness of things if the present Petition is disposed of at this stage giving liberty to the Petitioners to first go to the learned Trial Magistrate and, in response to the impugned notice, they can agitate all the pleas available to them. Ordered accordingly. If any such motion is moved by the Petitioners, the learned Trial Magistrate shall exempt the Petitioners from appearing in person.
07.
The Petition is thus disposed of on the above terms, along with connected CrlM(s).
08.
This Order shall, however, not come in the way of the Petitioners to approach this Court again, in case afterwards they find it appropriate.
