Learned advocate appearing for the petitioner submits that the other accused persons have been granted bail by the Hon’ble Supreme Court only on the issue relating to long incarceration. From the said accused persons 9000 bottles of phensedyl were recovered from a vehicle. Petitioner was initially arrested on the statement of co-accused and subsequently 1200 bottles of phensedyl were recovered and is in custody for 2 years 10 months and out of 18 witnesses cited by the prosecution only 2 witnesses have been examined. Learned advocate for the State opposes the prayer for bail and submits that it is the petitioner who is engineering the offence. 2 There has been recovery from him and is completely separately placed, the truck from which seizure was effected belonged to the relation of the petitioner. There are other NDPS cases against the present petitioner being Airport P.S. Case No.315 of 2022, Sankrail P.S. Case No.681 of 2023 and Basirhat P.S. Case No.396 of 2016. All the aforesaid cases are for violation of the NDPS Act. Having considered the conduct of the present petitioner and the petitioner being a history-sheeter, I am not inclined to extend the same benefit to the present petitioner. As such, the prayer for bail of the petitioner in CRM(NDPS) 1872 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
