Order 06/03/2026
1. Parties are present in person and they have duly been identified by their respective counsel.
2. By way of this Criminal Misc. Petition under Section 482 Cr.P.C. (528 BNSS), the accused-petitioner has approached this Court with a prayer to quash the FIR No.228/2024 registered at Police Station Civil Line, District Ajmer for offences punishable under Sections 384, 385, 504 & 506 of the IPC.
3.
Learned counsel for the petitioner submits that cross cases have been registered between the parties. It is submitted that now, parties have settled their dispute amicably. Counsel submits that due to compromise, further proceedings in the aforesaid FIR are fruitless and continuation thereof would be a futile exercise and a waste of precious judicial time and resources. [2026:RJ-JP:9805] (2 of 3) [CRLMP-4145/2024]
4. Learned Senior counsel appearing on behalf of the complainant does not dispute the factum of compromise and under the instructions of the complainant, who is present in Court, submits that he has no objection if this petition is allowed and impugned FIR lodged against the petitioner may be quashed on the basis of amicable settlement arrived at between the parties. 5. Learned Public Prosecutor has verified the factum of compromise. 6. It has come to the notice of this Court that initially, relationship between the petitioner and the complainant was consensual in nature, however, overtime, their relation deteriorated, ultimately leading to the filing of FIRs against each other. Now, both the parties have resolved their dispute amicably and the complainant does not want to continue the criminal proceedings against the petitioner. Moreover, in cross case filed by the present petitioner against the complainant, this Court has quashed the FIR on the basis of compromise today itself. In such circumstances, continuation of criminal proceedings against the petitioner would be a futile exercise and a waste of precious judicial time and resources. 7. In view of the aforesaid and considering the submissions made on behalf of the respective parties; the material made available for perusal; considering the facts that parties have resolved their dispute amicably and FIR in cross case has also been quashed by this Court today itself, so also finding that the present case is wholly covered by the principle of law laid down by Hon'ble Supreme Court in the case of Gian Singh versus State
