Vs.
The State of W.B. & Ors.
Md. Yusuf Ali Mr. Imdadul Biswas
…for the petitioner.
Md. Harun Al Rashid Sk. Morshed Ali …for the private respondents.
Mr. Debangshu Biswas Mr. Atreya Chakraborty …for the State.
The petitioner who is the Upa Pradhan of Mahula-II Gram Panchayat has assailed the no confidence motion submitted by the private respondents/members of the Panchayat on 3rd August, 2026 on the ground that on receipt of the motion, the Prescribed Authority issued the notice of meeting on 21st August, 2026 fixing the date of meeting on 8th September, 2026 in violation of Section 12(3) and 12(4) of the West Bengal Panchayat Act, 1973. It is evident from the notice issued by the Prescribed Authority that it is violation of Sections 12(3) and 12(4) of the Act of 1973. The no confidence motion and consequential steps taken by the Prescribed Authority pursuant to the said motion are therefore quashed/set aside.
2 On prayer of the private respondents, liberty is granted to submit a fresh motion before the Prescribed Authority in terms of Section 12 of the Act of 1973. In the event such motion is submitted, the Prescribed Authority shall deal with the same in terms of the said provision of law, particularly the time frame stipulated therein. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
