02.09.2026 Serial no. 81 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1876 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Chakulia PS Case No. 37 of 2026 dated February 01, 2026 u/s 21(c)/23 of the NDPS Act [Spl. NDPS case no. 07 of 2026] . -And- In the matter of : Mahamud Alam … Petitioner(s) Mr. Navanil De Mr. Srinjan Ghosh … for the Petitioner(s) Mr. Amal Kumar Datta Mr. Shataroop Purkayastha … for the State-respondent(s) The petitioner was arrested in connection with the instant case on 1st February, 2026 and since then he is in custody. State opposes the prayer for bail and submits that from the joint possession of the petitioner and another 138 bottles of codeine phosphate were recovered. Having considered that the quantum recovered in the present case is above the commercial quantity, I am of the opinion that the rigors of section 37 of the NDPS Act are attracted. Hence, the prayer for bail of the petitioner is Rejected. 2 Accordingly, CRM (NDPS) 1876 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
