ORAL ORDER
1. Learned AGA accepts notice for respondent Nos.1 to
3.
2. The petitioners are before this Court seeking for the following reliefs:
"i. To quash the impugned order/endorsement bearing No.SRO/KPURA/180/2026-27, dated 27.07.2026 passed by the Respondent No.3 as found at Annexure-A in respect of (i) Sy.No.53/3 measuring 07 guntas out of 35 guntas, (ii) Sy.No.52/2 measuring 31/4 guntas out of 21 guntas, (iii) Kaneshumari No.3/3/3 building measuring 125.40 square feet and (iv) Kaneshumari No.3/3/3, vacant site measuring 90 square feet, all are situated at Chikkamuduvadi Village, Kasaba Hobli, Kanakapura Taluk and consequently; ii. To direct the Respondent No.3 to register the final decree issued by the Hon'ble II Additional Civil Judge & JMFC at Kanakapura in F.D.P.No.1/2012 in favour of petitioners at Annexure-E in respect of (i) Sy.No.53/3 measuring 07 guntas out of 35 guntas, (ii) Sy.No.52/2 measuring 31/4 guntas out of 21 guntas, (iii) Kaneshumari No.3/3/3 building measuring 125.40 square feet and (iv) Kaneshumari No.3/3/3, vacant site measuring 90 square feet, all are situated at Chikkamuduvadi Village, Kasaba Hobli, Kanakapura Taluk; & iii. To allow this writ petition and issue any other appropriate writ or direction or pass any other orders as this Hon'ble court deems fit to pass in the

circumstances of the case, in the interest of justice and equity."
3. The grievance of the petitioners is that the respondents have not registered the final decree drawn up in FDP No.1/2012 by the II Additional Civil Judge and JMFC, Kanakapura, on the ground that the 11-E sketch had not been produced along with decree.
4. The Division Bench of this Court, in RFA No.9/2014, decided on 03.06.2026, in Mahabeer Mallaraj Urs v. Sri V. Srinivasa, has held that, when a decree is passed by a competent Civil Court, there is no requirement for production of an 11-E sketch.

Learned Additional Government Advocate would, however, contend that since the property has not been identified and the phodies and durasti as regards to the said survey numbers have not been carried out, if the registration is made, there could be a possibility of further litigation arising thereto and

claims being made against Sub-Registrar and/or the Revenue Authorities as regards such registration.

Learned counsel for the petitioners would submit that the petitioners are only seeking for registration of the final decree and as per decree drawn up. The petitioners will not hold any of the respondent- officers responsible with regard to the extent or location of the property.
7. The said submission of the learned counsel for the petitioners addresses the apprehension expressed by the learned Additional Government Advocate
8. In that view of the matter, this Court passes the following:
ORDER i. The writ petition is allowed. ii. The endorsement bearing No.SRO/KPURA/180/2026-27 dated

27.07.2026 passed by respondent No.3 at Annexure-A is quashed. iii. Respondent No.3 is directed to register the final decree issued by the II Additional Civil Judge and JMFC, Kanakapura in FDP No.1/2012, within a period of 30 days from the date of receipt of a copy of this
order. iv. In terms of the undertaking and submission made by learned counsel for the petitioners, the aforesaid registration shall, however, be subject to the result of the appeal pending before the Hon'ble Apex Court arising out of the proceedings in G. Ramachar vs. State of Karnataka.
