Sl.33 02.09.2026 Court No.6 BP C.O. 2814 of 2026
Biswajit Sen -versus- Babita Sen (Das)
Mr. Gunjan Kumar Singh Mr. Vikas Kumar Ms. Rima Mandal ..for the petitioner
This application under Article 227 of the Constitution of India is at the instance of the husband and is directed against an order being no.11 dated 11th February, 2026 passed by the learned Additional District Judge, 1st Court at Chinsurah, Hooghly in Misc. Case No. 124 of 2025. By the order impugned the learned Additional District Judge, 1st Court at Chinsurah, Hooghly directed the petitioner/husband to pay a sum of Rs. 10,000/- per month to the wife/opposite party herein as alimony pendente lite from the date of filing of the application excluding the amount already awarded in favour of the wife/opposite party by the learned Magistrate. The learned advocate appearing for the petitioner would strenuously contend that the learned trial judge did not take into consideration the assets and liabilities filed by the petitioner. In support of his contention that the alimony pendente lite fixed by the learned trial judge is on higher side the learned advocate draws the attention of
2 the court to the assets and liabilities filed by the petitioner before the learned trial judge. On a cursory glance of the affidavit of assets and liabilities filed by the petitioner it appears that the petitioner admitted his monthly income to be Rs. 60,000/-. In view of such admitted fact this Court finds that the alimony pendente lite fixed at Rs. 10,000/- per month cannot be said to be an excessive one. That apart, the learned trial judge also allowed the adjustment of the amount which the petitioner has been directed to pay to the wife/opposite party pursuant to the direction passed by the learned Magistrate in a proceeding under Section 125 of the Criminal Procedure Code. In view of the reasons as aforesaid, this Court is not inclined to interfere with the order impugned. Accordingly, C.O. 2814 of 2026 stands dismissed. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
