ORAL ORDER
1.
Learned counsel for the petitioner after arguing the matter for some time submits that CW2 is the sole eye witness in the present case. Petitioner has no other criminal antecedents. He is in custody from 08.12.2025. Therefore, this petition may be dismissed as not pressed with liberty to the petitioner to file a fresh bail application before the Trial Court after CW2-Saroja is examined. He submits that considering the background in which the incident took place and period of the petitioner's incarceration, the Trial Court may be directed to examine the aforesaid eye witness on priority within a time frame.
2. Learned Addl. SPP submits that she has no objection for the prayer made by the petitioner.
3. The aforesaid submission are placed on record. Petition is dismissed as not pressed with liberty to the petitioner to file a fresh bail application before the Trial Court after CW2-Saroja, the alleged eye witness, is examined.

4. The prosecution as well as the Trial Court shall make endeavors to examine CW2 expeditiously on priority but not later than the period of six months from the date of receipt of a copy of this order.
5. It is made clear that immediately after examination of CW2 or after expiry of the period of six months as aforesaid, whichever is earlier, the petitioner shall be at liberty to file a fresh bail application before the Trial Court.
