27.08.2026 Item no.27 Ct. No.237 Suman C.R.R. 3408 of 2026 Aritra Ghosh @ Aritro Ghosh Vs. The State of West Bengal Mr. Shoubhik Mitter Mr. Avik Ghatak Ms. Afreen Begum Mr. Akash Ghosh ..for the petitioner Mr. Kallol Mondal, ld. P.P. Mr. Subir Ganguly Mr. Sandeep Prasad Shaw ..for the State The petitioner seeks expeditious disposal of the proceedings in Sessions Trial No. 8(3) of 2025, corresponding to Sessions Case No. 33 of 2025, arising out of Dakshineswar Police Station Case No. 91 of 2024, dated 03.07.2024, corresponding to G.R. Case No. 4485 of 2024, under Section 111 of the Bharatiya Nyaya Sanhita, 2023, presently pending before the Court of the learned Additional District and Sessions Judge, Fast Track Court No. 1, Barrackpore, North 24 Parganas. Mr. Shoubhik Mitter, learned advocate appearing for the petitioner, submits that, in the instant case, out of 15 charge- sheeted witnesses, 14 witnesses have already been examined, while the examination of the remaining one witness is partly complete. Thereafter, there has been no further progress in the trial, as the Court is presently lying vacant. It does not appear that there has been any inordinate delay in the conduct of the trial. Since the trial Court is lying vacant, there appears to be reasonable justification for the non-progress of the trial. In view of the aforesaid circumstances, I am not inclined to pass any order in the present application. The petitioner shall, however, be at liberty to renew his prayer after a period of three months, provided the regular Judge has resumed sitting in the said Court. Accordingly, C.R.R. 3408 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
