Affidavit of service filed by the petitioners is taken on record. The State is not represented despite service. Mr. Sundar Gopal Bhattacharya who usually appears for the State and is present in Court, is requested to represent the State in this matter. His appointment be regularized by the appropriate authority. The petitioner is directed to serve copy of the writ petition alongwith annexure thereto upon the learned counsel for the State in course of this day. The office of the Pradhan of Mothabari Gram Panchayat fell vacant upon removal of the Pradhan on 11th August, 2026. By a notice issued on 14th August, 2026, the Prescribed Authority fixed the date of meeting for election of the new Pradhan on 24th August, 2026. However, the meeting was postponed due to non- availability of sanctioned police force. The Prescribed Authority issued a fresh notice on 31st August, 2026 fixing the date of meeting on 8th September, 2026.
2 The petitioners seek a direction upon the police authority to render necessary assistance to the Prescribed Authority so that the meeting is held without any hindrance. In view of the above, the Prescribed Authority and Block Development Officer, Kaliachak-II Development Block, being the 7th respondent herein, is directed to conduct the meeting on the date fixed, that is, on 8th September, 2026. The Officer in Charge of Mothabari Police Station, being the 8th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully and without any disturbance from any corner whatsoever. The police authority shall ensure safe passage of the members to the venue of the meeting so that they are able to cast their votes freely, safely and independently. The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
