Learned counsel for the petitioner submits that the complaints submitted by the petitioner before the Prescribed Authority/Sub-Divisional Officer, Chanchal Sub-Division under Section 11(1)(d) of the West Bengal Panchayat Act, 1973 have not been considered as yet. Show cause notices have been issued upon the private respondents by the Prescribed Authority on August 21, 2026 fixing the date of meeting on September 01, 2026. Learned counsel for the private respondents submits that they ought to be given an opportunity of hearing by the Prescribed Authority so that they are able to place their contention before the said authority. Learned counsel for the State submits, on instruction, that the meeting scheduled to be held on September 01, 2026 has been held. However, learned counsel is unable to apprise the Court whether hearing has been concluded or a further date of hearing has been fixed by the Prescribed Authority. In view of the above, this Court is inclined to hold that since the complaints lodged by the petitioner have been taken up for consideration by the Prescribed Authority, the said Authority, being the 7th respondent herein, is directed to conclude the hearing and pass a reasoned order upon hearing both the parties, within two weeks from the date of communication of this order. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
