ORAL ORDER

Heard the learned counsel for the complainant and
learned counsel for the accused.
2. This contempt petition is filed seeking initiation of action against the accused for non-compliance of the order dated 11.08.2021 passed in Writ Petition No.13999/2009.
3. It appears that an award passed in Ref.No.18/2002 by the Presiding Officer of the Labour Court, Bengaluru came to be challenged before this Court by the respondent / accused. The writ petition was dismissed while confirming the award dated 01.12.2008 passed by the II Additional Labor Court, Bengaluru and the accused was directed to settle all monetary dues of the workman within a period of three months from the date of receipt of this order.

Learned counsel for the accused has referred to an
order passed by a coordinate bench of this Court whereby an interim stay on the execution of the award was made, providing that entire monetary dues of the complainant be deposited before the concerned Labour Court. The complainant was also permitted withdrawal of the deposited amount subject to certain conditions.
5. That being the case and as has been fairly conceded by the learned counsel for the complainant there exist no contempt. The contempt petition is consigned.
