02.09.2026 Serial no. 84 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1879 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with English Bazar PS Case No. 2499 of 2025 dated 12.12.2025 u/s 21(c)/29 of the NDPS Act. -And- In the matter of : Samiullah Momin &Anr. … Petitioner(s) Mr. Hillol Saha Podder Mr. Apan Saha Mr. T. Ahamed … for the Petitioner(s) Mr. Guru Das Mitra Ms. Shalu Gupta … for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are similarly placed as the other accused person who has been granted bail and there are no materials to connect the present petitioners who have been arrested and are in custody since 21.01.2026. Learned advocate for the State opposes the prayer for bail and submits that the recovery in the present case is 515 gm of brown sugar and so far as the present petitioners are concerned, both of them are accused in a case relating to English Bazar PS Case No. 2509 of 2025 dated 15.12.2025. 2 Having considered that the petitioners are also involved in respect of an offence under the NDPS Act, I am not inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Rejected. Accordingly, CRM (NDPS) 1879 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
