Hon’ble Shri Bibhu Datta Guru, Judge Order on Board 29.09.2026
1. Learned counsel appearing for the petitioner assails Annexure P/1, whereby the petitioner’s claim for appointment on compassionate grounds has been rejected on the ground that the surname of the petitioner’s father is different from the surname of the petitioner. 2. Learned counsel appearing for the respondents submits that the petitioner may re-agitate her claim by producing a succession certificate issued by the competent authority/court of competent jurisdiction, establishing the petitioner as the legal heir of the deceased employee. 3. Learned counsel for the petitioner submits that, in view of the aforesaid submission made on behalf of the respondents, the present writ petition may be disposed of with liberty to the petitioner to avail the said remedy. 3
4. In the aforesaid circumstances, the ends of justice would be met if the petitioner is granted liberty to obtain a succession certificate from the competent authority/court of competent jurisdiction establishing her as the legal heir of the deceased employee. 5. In the event the petitioner obtains such succession certificate and submits the same before the authorities concerned, the authorities shall consider the petitioner’s claim for appointment on compassionate grounds afresh and process the same in accordance with the applicable rules/policy and in accordance with law, without being influenced by the order impugned in the present writ petition. 6.
It is made clear that this Court has not expressed any opinion on the merits of the petitioner’s claim for compassionate appointment, and the same shall be considered by the competent authority independently in accordance with law. 4
7. With the aforesaid observations and directions, the writ petition stands disposed of. Sd/-
