In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hingalganj Police Station Case No. 96 of 2025 dated 29.04.2025 under Sections 318(4)/336/338/336(3)/336(4)/340/61(1) of BNS, 2023 and Section 14A(b) of Foreigners Act.

Learned advocate appearing for the petitioner submits petitioner is in custody for 1 year and 4 months.
State opposes the prayer for bail. Records reflect that 5 witnesses have been examined out of 16 witnesses cited by the prosecution.
Having considered the period of detention of the present petitioner and there being no possibility of the trial being completed as also the factum that the prescribed punishment are for limited period, I am of the opinion petitioner be released on bail.
2 Accordingly, Petitioner, namely, Md. Zahangir Hossen @ Jahangir Gazi shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Basirhat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Trial Court.
Additionally, petitioner shall meet with the Officer-in- Charge of Hingalganj Police Station once in every fortnight till the criminal proceedings are completed.
Accordingly, CRM (M) 1744 of 2026 is allowed.
Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
