ORAL ORDER
1. The petitioner – wife of the detenu – B.T.Rishikumar (CTP No.8174) is before this Court seeking for the following reliefs; a) Issue writ order or direction in the nature of Mandamus to the Respondents to grant parole of 90 days to the Convict B.T. Rishikumar S/o Late Thimmaiah (Bearing CTP No.8174) b) Pass such other order/s, directions considering the facts and circumstances of the case, together with costs in the interest of justice.
2. The detenu had been convicted in S.C.No.99/2007 for offences under Section 302, 324, 341, 427 r/w 34 of IPC by the 7th Additional District and Sessions Judge, Bangalore Rural District and sentenced on 21.11.2015 with the imprisonment for life. The detenu having made an application for parole, the same came to be rejected.

3. The detenu has served a period of 13 years 1 month 21 days of imprisonment as on 25.06.2026 and had been granted general parole on four earlier occasions, court parole on three occasions and emergency parole on seven occasions. The only ground on which parole was rejected was that there is a pendency of another criminal proceedings in SC No.665/2010 for offences under Section 143, 148, 302, 120(b) of the IPC. The detenu having been granted parole on 14 occasions when there is no complaint against the detenu, it ought not to have been rejected this time. Hence, this Court passes the following:
ORDER i) The Writ Petition is allowed. ii) The concerned respondent is directed to release the detenu - – B.T.Rishikumar (CTP No.8174) on parole for a period of 90 days commencing from 07.09.2026, subject to the following conditions: a) The detenu shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in

the event, the detenu would evade going back to the gaol, after the expiry of the period of parole. b) Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii) The Registry is directed to communicate the order to the prison authority for its immediate execution. iv) The petitioner and family members of the detenu to comply with all other formalities before the date fixed for release.
