Learned advocate appearing for the petitioner submits that petitioner is similarly situated as other accused person who has been granted bail. The subject-matter of the present case relates to alleged recovery of 525 grams of Brown Sugar from the joint possession of the petitioner and another. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that so far as the present petitioner is concerned, there are criminal antecedents relating to Kaliachak P.S. Case No. 1063 of 2020 and Kaliachak P.S. Case No. 1190 of 2021. Rebutting such submission of the State, learned advocate for the petitioner submits that petitioner has been granted bail in the said cases after he was in custody for two years. 2 Having considered the fact that in the previous case, petitioner was granted bail as the trial could not proceed and while on bail, from the joint possession of the petitioner and another, there has been recovery, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1866 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
