Petitioner is before this Court seeking to issue writ of mandamus to the respondent to consider his representation as per Annexure-E.

Learned counsel for the petitioner submits that the lands belonged to the petitioner shown in paragraph No.1 of the Writ Petition have been acquired by the respondent- Karnataka Industrial Area Development Board.
3. Petitioner has been allotted about 517.50 square meters of land adjacent to Plot No.256-B of Bomassandra industrial area for setting up of a Hotel Project, in terms of allotment letter dated 05.01.2011.
4. The present application at Annexure-E is filed seeking further allotment of about 5 guntas of land apparently fallen vacant next to the land already allotted to petitioner.

Learned counsel for the petitioner therefore submits that direction be issued to the respondent- Authority to allot the said 5 guntas of land. However, on a query by this Court,
learned counsel for the petitioner is unable to point out any constitutional or legal rights in favour of the petitioner for allotment of the said land. Therefore, mandamus cannot be issued for mere asking for convenience in the absence of party establishing his statutory and constitutional rights and breach thereof by the Authority.
6. Accordingly, the Writ Petition is dismissed.
7. Notwithstanding the dismissal, it is open to the petitioner to approach the respondent-Authority, who may consider his request if he otherwise satisfies the eligibility criteria for allotment of land. Sd/- (M.G.S. KAMAL) JUDGE GVP List No.: 1 Sl No.: 35
