….for the State. Learned advocate appearing for the petitioners claims innocence of the charges leveled against them. State has produced the case diary. Case diary reflects that petitioners last entered India on June, 2025. There are documents in the case diary to reflect that petitioners are having nationality of a foreign country. The main accusation against the petitioners is that they have entered India legally but are continuing to stay illegally. Both the petitioners are in custody for more than 10 months. The prescribed punishments are for fixed period of term and the case has very recently been committed to the Court of Sessions. 2
Having regard to the same that some time will be taken to take the trial to its logical conclusion, I am of the opinion that petitioners be released on bail. Accordingly, Petitioners, namely, (1) Harichand Mondal, (2) Sujoy Mondal @ Sujay Kumar Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Bongaon, North 24 Parganas. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Trial Court. Additionally, both the petitioners would meet with the Officer-in-Charge of Gaighata Police Station once in every 15 days during the pendency of the criminal proceedings. With the aforesaid observations CRM (M) 1736 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
