After addressing the arguments for some time,
learned counsel for the appellant has filed a memo. Memo reads as under:
"The appellant in the above appeal has challenged the Judgment and decree dated 24.11.2016 passed by the learned Principal Senior Civil Judge and CJM Shivamogga in R.A.No.18/2013 dismissing the appeal and thereby confirming the judgment and decree dated 24.11.2012 passed by the learned First Addl. Civil Judge and JMFC Shivamogga in O.S.No.390/2001 dismissing the suit filed by him seeking decree of permanent injunction in respect of the suit schedule property. The Trial Court was pleased to answer issue No.4 partly in favour of the appellant. The appellant now has been advised to file a comprehensive suit seeking declaration of his title over the suit schedule property along with other consequential reliefs. In view of the above, the appellant may be permitted to withdraw the above appeal with liberty to file a fresh suit seeking declaration of
