1. This case is listed on default regarding maintainability. 2.
By way of this appeal, the appellant is challenging following different orders : (i) the order dated 16.07.2025 passed by the learned Special Judge (Atrocities), Balodabazar, District Balodabazar-Bhatapara (C.G.), in Special Sessions Case No.03/2025, whereby the case was remitted back to the Court of learned C.J.M., Balodabazar; (ii) the subsequent order dated 24.10.2025 passed by the learned C.J.M., Balodabazar, in Criminal Case No.2936/2025, whereby charges under Sections 420, 467, 468, 471 and 34 of the I.P.C. were framed against the accused; and (iii) the order dated 02.12.2025 passed by the learned Sessions Judge, Balodabazar, in Criminal Revision No.1388/2025, whereby the criminal revision preferred by the petitioner/appellant against the aforesaid order dated 24.10.2025 was dismissed. 3
3. Thus, the appellant is challenging three different orders passed by three different Courts in three separate proceedings. Therefore, the Registry has rightly pointed out the default that the present appeal, in the manner in which it has been drafted, is not maintainable. 4. At this stage, the appellant seeks permission of this Court to withdraw the present appeal with liberty to file a fresh appeal, in accordance with law, against the order dated 16.07.2025 passed by the learned Special Judge (Atrocities), Balodabazar, in Special Sessions Case No. 03/2025 (State of C.G. Vs. Suraj Bai Agrawal and others). 5. Learned State counsel has no objection to the prayer made by the appellant. 6. In view of the above, the present appeal is permitted to be withdrawn and is accordingly disposed of with the liberty as prayed for. 7. It is made clear that the liberty so granted shall be availed of by the appellant within a period of 30 days from today. 8. As prayed, the certified copies of the impugned orders be returned to the appellant after retaining photocopies thereof. 9. Pending application, if any, also stands disposed of.
