3. It has been argued by learned counsel for the applicant that the applicant has falsely been implicated in this case. He also submits that 2.232 Kgs of Ganja was seized from the joint possession of the applicant and co-accused. It is further argued that the applicant has one criminal antecedent, which is pending consideration, he is in jail since 11.05.2026 and conclusion of the trial is likely to take some time. It is also submitted that co-accused has already been granted bail by this Court vide order dated 07.08.2026 passed in MCRC No. 7224 of 2026. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned counsel appearing for the State/non-applicant would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court. She further submits that the applicant has one criminal antecedent of similar nature and 2.232 Kgs of Ganja was seized from the joint possession of the applicant and co-accused; therefore, the applicant is not entitled for grant of bail. 5.
I have heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the facts and circumstances of the case, the fact that 2.232 Kgs of Ganja was recovered from the joint possession of the applicant and co-accused, which is less than commercial quantity, and also considering the fact that the applicant has one criminal antecedent of similar nature, which is pending consideration. Further, co-accused has already been granted bail by this Court vide order dated 07.08.2026 passed in MCRC No. 7224 of 2026, charge-sheet has been filed before the competent Court, applicant is in jail since 11.05.2026 and conclusion of the trial may take some time. 3 Therefore, this Court is of the view that the applicant is entitled to be released on bail in this case. 7. Accordingly, the regular bail application is allowed and it is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (iv) In case of repetition of any offence of similar nature, the bail granted to the applicant shall stand cancelled automatically. Sd/-
