Accused No.1 in Crime No.453 of 2026 registered by Ramamurthy Nagar Police Station, Bengaluru City for offences punishable under Sections109, 3(5), 351(2), 352, 61, 78 & 85 of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.453 of 2026 was registered by Ramamurthy Nagar Police Station, Bengaluru City for the aforesaid offences against the petitioner and another based on the first information dated 13.07.2026 received from Smt. N Pavitra, who is the wife of the petitioner. Apprehending arrest in case, the petitioner had approached the jurisdictional Sessions Court in Crl.Misc.No.7161 of 2026 which was rejected on 27.07.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, the injured victim is the wife of the petitioner and there is a serious marital dispute between them. The couple are already - 3 - HC-KAR CNR: KAHC010547382026 NC: 2026:KHC:47302 CRL.P No. 12093 of 2026 before the jurisdictional Court in a divorce proceedings. Allegation against the petitioner is that he had assaulted the victim on 11.07.2026 and tried to commit her murder. In respect of the alleged incident that had taken place on 11.07.2026, first information is belatedly filed on 13.07.2026 at about 21.00 hours. 5. In the first information, it is stated that on 11.07.2026 at about 09.53 p.m. petitioner who came near the residence of the first informant carrying a knife along with his brother had attempted to stab her and when she raised a cry, the public overpowered the petitioner and immediately called the police. Thereafter, the police who came to the spot, allegedly took the petitioner to custody and also recovered the knife. However, the first information in the present case is belatedly submitted on 13.07.2026, which is after a period of 2 days from the date of incident. 6. Considering the aforesaid aspect of the matter, I am of the opinion that the prayer made by the petitioner for - 4 - HC-KAR CNR: KAHC010547382026 NC: 2026:KHC:47302 CRL.P No. 12093 of 2026 grant of anticipatory bail needs to allowed. Accordingly, the following:- ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.453 of 2026 registered by Ramamurthy Nagar Police Station, Bengaluru City for offences punishable under Sections109, 3(5), 351(2), 352, 61, 78 & 85 of BNS, 2023, subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - HC-KAR CNR: KAHC010547382026 NC: 2026:KHC:47302 CRL.P No. 12093 of 2026 3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
