This writ petition has been filed under Article 227 of the Constitution of India with the following prayers :- “(i) To direct the learned First Additional Civil Judge (Junior Division), Haldwani District Nainital to expedite the proceedings of Civil Suit No.80 of 2014, “Sri Harendra Singh vs. Sri Shamsher Singh and Ors”, pending in its court, within a time-bound period as may be fixed by this Hon’ble Court. (ii) Pass any other order which this Hon’ble Court may deem fit and proper under the circumstances of the case”. 2. Heard Mr. Jai Krishna Pandey, learned counsel for the petitioner. 3. Mr. Jai Krishna Pandey, Advocate submitted that the petitioner, the senior citizen, aged about 74 years, is the defendant no.1 in Civil Suit No.80 of 2014, 1 2026:UHC:3088 filed for partition. The evidence of the defendants has been completed. The said case is pending since 05.11.2014. 4. Having heard and in the facts and circumstances of the case, the learned trial court is directed to expedite the proceedings of Civil Suit No.80 of 2014, “Sri Harendra Singh vs. Sri Shamsher Singh and Others” and decide the same as expeditiously as possible, as per law, but not later than four months from the date of production of certified copy of this order. 5. With the aforesaid directions, the present Writ Petition [No.1032 of 2026 (M/S)] is disposed of. 6.
