27.02.2026 Court No.35. D/L.17. Rakib CRM 7826 of 2014 In Re: An Application for Cancellation of Bail Under Section 439(2) of the Code of Criminal Procedure, 1973. And In the matter of : Barendra Nath Bera ……Petitioner. The application was preferred challenging the order dated 21.02.2014 passed in connection with New Town Police Station case no. 433 of 2013 dated 25.11.2013 passed by the learned Sessions Judge, North 24 Parganas in Criminal Misc. Case no. 953 of 2014. Having considered that the grievance was relating to the order of bail passed by the learned Sessions Judge and more than 12 years have passed and none appears on behalf of the petitioner or for the State, I am of the opinion that by efflux of time the application becomes infructuous. Accordingly, CRM 7826 of 2014 is dismissed. In case, there are fresh circumstances the same will not prevent the de-facto complainant from bringing the same to the notice of the jurisdictional Court which would decide the issue according to the circumstances warranted for the purposes of progress of the case.
