Heard learned counsel for petitioner. In spite of service of notice to the respondent, he has not turned up
2. This petition is filed by wife for transfer of MC No.441/2022 filed by husband for restitution of conjugal rights before the Principal Family Court at Bangalore to the Principal Family Court, Chikmagaluru.
3. It is stated that she is residing in Chikmangalore with her parents. She is not working and earning. She is having children aged 4 years and one year respectively. The first child is studying in Chikmagaluru. Respondent had filed G&WC No.3/2026 for custody of the children before Chikamagaluru court and she also filed MC.No.189/2025 under sections 19 and 26 of DV Act before the Family Court at Bengaluru. filed restitution of conjugal rights after the filing of divorce and both the matters are to be disposed of by one court to avoid conflict in decisions, this Court finds that it is just and reasonable to transfer MC No.7441/2025 filed by husband from Family court at Bangalore to Family court at Chikmagalur. Accordingly, this petition is hereby allowed. Family Court is specifically directed to club both the matters and to dispose of them together to avoid conflicting decisions. Pending IA is disposed of in view of the disposal of the main petition.
