Order on Board 30.09
.2026
1. This is the second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 295/2026 registered at Police Station Kotwali, District Jagdalpur (C.G.), for the offence punishable under Section 309(6) of BNS.
2. Earlier, first bail application i.e. MCRC No. 7108 of 2026 was rejected as withdrawn vide order dated 10.09.2026.
3. As per the case of the prosecution, on 29.06.2026, between 7:30 p.m. and 8:00 p.m., the complainant Roshan Jha was returning home on his SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.10.01 10:48:39 +0530
2 motorcycle. When he reached near house of the applicant, a scuffle ensued between them. It is alleged that when the complainant attempted to call the police, the applicant slapped him and looted his mobile phone and Rs.1500/-. On such complaint, the police registered offence as stated above.
4.
Learned counsel for the applicant submits that there was some dispute between the complainant and the applicant and the contents of FIR would clearly establish that no such incident, as alleged, had taken place. He would submit that the complainant was present in front of the house of the applicant and a scuffle ensued between them. He would submit that complainant has made a false complaint of loot, etc against the applicant and there is delay of 11 days in lodging the FIR. He would submit that the charge-sheet has already been filed, applicant is in jail since 10.07.2026 and he has no criminal antecedents of similar nature. He would pray for grant of bail.
5. On the other hand, learned counsel for the State would oppose the bail application. He would submit that the present applicant looted the mobile phone and Rs.1,500/- from the complainant. It is also argued that the applicant has two antecedents, registered in the year 2021 and 2026, under the NDPS Act, therefore, instant application deserves to be rejected.
6. I have heard learned counsel appearing for the parties and perused the case diary.
7. Having considered the fact that the applicant has no criminal antecedents of similar nature, charge-sheet has already been filed, applicant is in jail since 10.07.2026, there was scuffle between the applicant and the complainant, and FIR was lodged with delay of 11 days, I am inclined to allow this application.

8. Accordingly, the regular bail application is allowed and it is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
