.2026
1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 45/2026 registered at Police Station Sihawa, District Dhamtari (C.G.), for the offence punishable under Section 20 (b) of NDPS Act.
2. Case of the prosecution, in brief, is that on 10.06.2026, the police of Police SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.09.29 17:48:19 +0530
2 Station Sihawa, District Dhamtari intercepted a vehicle bearing registration No. MH 27-DT-0319 and seized 18.626 kgs of ganja from joint possession of the present applicants. Thereafter, the police registered the aforesaid offence against the present applicants.
3.
Learned counsel for the applicants submits that 18.626 kgs of Ganja was seized from joint possession of the applicants on 10.06.2026. He further submits that the applicants are in jail since 10.06.2026, charge-sheet has been filed and trial is likely to take some time for its conclusion. With regard to criminal antecedents of applicant No. 1 namely Praveen Ravindra Dubey, one case was registered in the year 2017 and another istgasa was registered in the year 2017 itself. He would contend that one criminal antecedent of applicant No. 2 namely Palash Gajbhiye was registered under BNS, which is still pending consideration and there is no criminal antecedents of applicant No. 3 namely Sonu Praveen Khairkar. He would contend that there are no criminal antecedents of similar nature, therefore, instant bail application may be allowed. 4. On the other hand, learned counsel for the State would oppose the bail application. She would submit that applicants No. 1 and 2 have criminal antecedents and 18.626 kgs of Ganja was seized from joint possession of applicants, therefore, instant application deserves to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the facts and circumstances of the case, nature and gravity of allegation levelled against the present applicants and the fact that there are two criminal antecedents of applicant No. 1 registered in the year
3 2017, one criminal case of applicant No. 2 under BNS and there is no criminal antecedents of applicant No. 3, charge-sheet has already been filed before the competent Court, applicants are in jail since 10.06.2026 and trial may take some time for its conclusion, I am inclined to grant bail to the present applicants. 7.
7. Accordingly, the regular bail application is allowed and it is directed that in the event of the applicants executing a personal bond for a sum of Rs.50,000/- each with one surety in the like sum to the satisfaction of the concerned trial Court, they shall be released on bail on the following conditions:- (i) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) they shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) they shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
