This writ petition has been filed under Article 227 of the Constitution of India with the following prayers :- “(i) To issue an appropriate order of direction to the learned Court of Consolidation Officer Bazpur, District Udham Singh Nagar to decide the objections filed u/s 5 of the Limitation Act, 1963 by the petitioners/defendants pending in suit no.468 of 2025 new no.12/26 within a span of 30 days or as early as possible. (ii) To issue such other suitable writ, order or direction which this Hon’ble Court may deem fit or proper. (iii) To award cost of the writ petition to the petitioners.” 2. Heard Mr. Prem Prakash Singh Phartiyal, learned counsel for the petitioners. 3. Mr. Prem Prakash Singh Phartiyal, Advocate submitted that the respondent has filed a Case (No.468 1 2026:UHC:3089 of 2025, New No. 12 of 2026, “Tilak Raj Sharma vs. Lokhi Singh and Others”) under Section 9A(2) of the Uttar Pradesh Consolidation of Holdings Act, 1953 (as applicable in the State of Uttarakhand) after the limitation period. The petitioner no.2-Lokhi Singh, aged about 68 years and the petitioner no.3-Ram Kishore, aged about 61 years are the senior citizens. The petitioners have filed their objection on the point of limitation, which is still pending. 4. In the facts and circumstances of the case, the present writ petition is disposed of directing the Consolidation Officer, Bazpur, District Udham Singh Nagar to decide the said Case (No.468 of 2025, New No. 12 of 2026), as expeditiously as possible, as per law, without granting any unnecessary adjournment to the parties. 5.
