Learned advocate for the petitioner submits that the petitioner is innocent and has been falsely implicated in connection with the instant case. The petitioner is detained for more than a year. Learned advocate for the State opposes the prayer for bail and submits that 38 kg of ganja were recovered in the present case and efforts are being exerted to commence the witness action. Having considered the quantum of recovery in the present case, I am of the opinion that the rigors of Section 37 of the NDPS Act are attracted. As such, I am not inclined to enlarge the petitioner on bail.
2 Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1859 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
